Debt redeemed?

Most of the time, the mortgage is cancelled after the loan has been redeemed completely. The notary will then cancel the registration in the public registers. This is done by notarial deed of cancellation. The mortgagee (the financier) has to give permission for it. If the mortgagee (the financier) is a private person, the owner/lessee would be wise to check that a deed of cancellation is prepared after redemption of his debt.

For in the event of death of the financier, the heirs may not be aware of the fact that the debt has been redeemed, but that the registration of the mortgage has not officially been cancelled as yet.
